Ce que proposait l'amendement

Cet amendement vise à reprendre en partie le dispositif de visites domiciliaires en dehors des heures prévues à l’article 64 du code des douanes (de 6 heures à 21 heures) adopté par le Sénat en y intégrant la possibilité offerte par le code de procédure pénale de réaliser des perquisitions de nuit… Cet amendement vise à reprendre en partie le dispositif de visites domiciliaires en dehors des heures prévues à l’article 64 du code des douanes (de 6 heures à 21 heures) adopté par le Sénat en y intégrant la possibilité offerte par le code de procédure pénale de réaliser des perquisitions de nuit dans le cadre de la flagrance (article 706-89 du code de procédure pénale).Une visite domiciliaire ne pourra être réalisée en flagrance hors des heures précitées uniquement dans le respect des conditions suivantes :– il y a commission en bande organisée d’un flagrant délit mentionné aux articles 414, 414-2 et 415 du code des douanes ;– les nécessités de l’enquête douanière l'exigent ;– le juge des libertés et de la détention délivre une ordonnance motivée comportant des mentions obligatoires à peine de nullité ;– les agents des douanes sont spécifiquement habilités.Ainsi, la mesure proposée exige que les opérations de visite domiciliaire aient lieu uniquement sur autorisation de l’autorité judiciaire, gardienne de la liberté individuelle, et que le déroulement des mesures autorisées soit assorti de garanties procédurales appropriées et effectives. Par ailleurs, l’amendement autorise les opérations de visite et de saisie en dehors des heures prévues par l'article 64 du code des douanes et hors la situation de flagrance, lorsque ces opérations ne concernent pas des locaux d'habitation, à l’instar de l’article 706-90 du code de procédure pénale.Par cohérence, l’amendement supprime l’extension de la possibilité de procéder à des perquisitions de nuit dans des locaux d’habitation en matière de criminalité organisée en dehors des cas de flagrant délit. Une telle extension apparaît difficilement conciliable avec les exigences constitutionnelles et n’est permise en l’état du droit qu’afin de prévenir un acte terroriste susceptible de porter atteinte à la vie ou à l’intégrité physique d’une personne. Il n’est pas souhaitable d’aller au-delà, d’autant que ce n’est pas un besoin exprimé par les praticiens.Ces dispositions visent à la constatation, sous le contrôle de l’autorité judiciaire, d’infractions douanières les plus graves, dans certains cas limitativement énumérés et uniquement si elles sont commises en bande organisée. Dans ces conditions, l’amendement opère une conciliation équilibrée entre les exigences constitutionnelles de la recherche des auteurs d’infractions et le droit au respect de la vie privée ainsi que l’inviolabilité du domicile.
