Ce que proposait l'amendement

Par cet amendement d'appel, le groupe La France insoumise souhaite préciser la notion de victimes des infractions visées par cette proposition de loi, qui recouvrent notamment le champ des violences commises à l'égard de mineurs, les violences sexistes et sexuelles, ainsi que les violences… Par cet amendement d'appel, le groupe La France insoumise souhaite préciser la notion de victimes des infractions visées par cette proposition de loi, qui recouvrent notamment le champ des violences commises à l'égard de mineurs, les violences sexistes et sexuelles, ainsi que les violences conjugales.Cet amendement d'appel vise à interroger le champ d'application et le public visé par ce nouveau guichet national de suivi des victimes.Selon l’enquête de victimation « Vécu et ressenti en matière de sécurité » de 2024 du ministère de l’Intérieur, suite aux viols, tentatives de viol et/ou agressions sexuelles qu’elles ont subi, seules 7% des femmes victimes déclarent avoir porté plainte. Entâmer des démarches judiciaires est difficile voire impossible pour les victimes, et ce pour plusieurs raisons : la sidération, l'amnésie traumatique, la défiance envers le système judiciaire, la peur, la honte et la culpabilité alimentées par la culture du viol et de l'omerta, etc. Ainsi, 93% des victimes ne portent pas plainte alors qu'elles ont également souffert du dommage causé par une infraction et des conséquences du stress post-traumatique entraînant de nombreux risques pour la santé : risques suicidaires, troubles du sommeil et de l'alimentation, addictions, troubles cardio-vasculaires, etc.Nous pensons que ces victimes devraient avoir le droit au même accompagnement, à la fois juridique, social et médical et souhaitons décorréler l’accompagnement et la prise en charge des victimes de la procédure pénale, qui vise à condamner l'auteur de l'agression mais ne répare pas.Pour toutes ces raisons, nous souhaitons préciser que ce guichet national de suivi des victimes s'adresse à toutes les victimes indépendamment des démarches judicaires entamées ou non.
