Cet amendement du groupe Ecologiste et social vise principalement à élargir les travaux susceptibles d’être financés par les prêts collectifs prévus à l’article 26-4 de la loi du 10 juillet 1965 afin de faciliter l’installation de protections solaires extérieures dans les copropriétés.Les… Cet amendement du groupe Ecologiste et social vise principalement à élargir les travaux susceptibles d’être financés par les prêts collectifs prévus à l’article 26-4 de la loi du 10 juillet 1965 afin de faciliter l’installation de protections solaires extérieures dans les copropriétés.Les protections solaires extérieures sur les baies vitrées constituent l’un des moyens les plus efficaces pour limiter l’inconfort thermique estival et réduire le recours à la climatisation. Pourtant, leur installation demeure aujourd’hui freinée par un cadre juridique et financier insuffisamment adapté.Cet amendement crée ainsi une nouvelle catégorie de travaux d’intérêt collectif à l’article 25 de la loi du 10 juillet 1965, visant explicitement les travaux d’installation de protections solaires extérieures, y compris lorsqu’ils affectent des parties privatives. Cette évolution permet de rendre ces travaux éligibles aux dispositifs de prêts collectifs prévus à l’article 26-4 de la même loi afin de lever les freins financiers à leur réalisation.Il prévoit également que l’autorisation donnée à un copropriétaire d’installer à ses frais des protections solaires affectant les parties communes ou l’aspect extérieur de l’immeuble puisse être adoptée à la majorité simple de l’article 24.À l’heure où les vagues de chaleur se multiplient, l’adaptation des logements aux fortes températures devient un enjeu majeur de santé publique, de confort d’usage et de sobriété énergétique. Pourtant, selon la Fondation pour le Logement, un logement sur trois se transforme aujourd’hui en véritable "bouilloire thermique" durant l’été. Dans ce contexte, il apparaît nécessaire de faciliter le déploiement de solutions passives de protection contre la chaleur dans l’habitat collectif.
