Par cet amendement, le groupe La France insoumise entend renforcer l’ambition des lois AGEC et EGALIM en étendant explicitement le champ d’application de la proposition de loi aux emballages et dispositifs de conditionnement alimentaires contenant des substances per- et polyfluoroalkylées (PFAS)… Par cet amendement, le groupe La France insoumise entend renforcer l’ambition des lois AGEC et EGALIM en étendant explicitement le champ d’application de la proposition de loi aux emballages et dispositifs de conditionnement alimentaires contenant des substances per- et polyfluoroalkylées (PFAS), ainsi qu’aux matériaux contenant des substances dangereuses au sens du règlement européen REACH, qu’ils soient partiellement ou entièrement composés de plastique. Il s’agit de répondre à l’enjeu majeur de contamination chimique des matériaux en contact avec les aliments, dans un contexte où les connaissances scientifiques mettent en évidence la persistance, la mobilité et la toxicité de nombreuses substances utilisées dans les emballages alimentaires.Les PFAS, dits « polluants éternels », font l’objet d’alertes scientifiques et institutionnelles répétées en raison de leur extrême persistance dans l’environnement et de leur capacité à s’accumuler dans les organismes vivants. Plusieurs travaux de l’Autorité européenne de sécurité des aliments (EFSA) ont notamment conclu à des effets préoccupants sur le système immunitaire et à la nécessité de réduire drastiquement l’exposition de la population à ces substances. Un recours a déjà été déposé par Notre affaire à tous, Bloom, Générations futures et des riverains des nombreux sites contaminés pour mettre l'Etat face à ses responsabilités sur l'inaction face aux polluants éternels. Il aura fallu le scandale de pollution dans la "vallée de la chimie" au sud de Lyon avec la plateforme Pierre-Bénite identifiée comme principale source de PFAS dans le Rhône (Source : Vert de rage) pour que l'Etat commence à informer la population à ce sujet. Le recours fait état d'une trentaine de rapports et études émanent d'institutions et agences documentant la pollution aux PFAS en France avant 2022. Rapport parlementaire en 2008 sur les risques pour la santé humaines des PFOS et du PFOA, alertes de l'Agence nationale de sécurité sanitaire (Anses), alarme de l'Institut national de l'environnement industriel et des risques sur la contamination du lait maternel. Le Monde et 29 médias partenaires estiment le coût de dépollution des PFAS à environ 100 milliards d'euros par an, ce qui représente plus de la moitié du budget annuel de l'Union européenne. Nous réaffirmons qu'il s'agit bien de maladies politiques liées à l'inaction répétée de l'Etat malgré l'urgence et la vague de rapports scientifiques faites sur le sujet.Dans ce contexte, les emballages alimentaires constituent une voie d’exposition quotidienne et massive de la population, y compris des enfants, à des substances chimiques dont les effets sanitaires sont graves et durables. Selon l’Assistance publique–Hôpitaux de Paris (AP-HP), le cancer constitue la deuxième cause de mortalité chez les enfants de plus d’un an en France, après les accidents.Cet amendement vise ainsi à garantir que les mesures d’interdiction ne se limitent pas aux seuls plastiques visibles ou aux usages les plus directs, mais englobent également les matériaux de conditionnement susceptibles de constituer une source d’exposition chimique diffuse, afin de renforcer la protection de la santé publique et d’assurer la cohérence de la législation avec les connaissances scientifiques disponibles.
