Cet amendement vise à permettre une meilleure coordination avec les dispositions de la directive cadre européenne 2008/98 relative aux déchets, dans son écriture résultant de la directive 2025/1892 du 10 septembre 2025. Il tient également compte des échanges avec la Commission Européenne dans le cadre de la notification au titre de la procédure de notification prévue par la directive 2015/1535.Ainsi, il est proposé de faire figurer de manière explicite à l’article L. 541-10-3 du code de l’environnement, qui liste les critères sur lesquels peuvent être basés une modulation des contributions des filières à responsabilité élargie du producteur (REP), les mentions figurant dans la directive 2025/1892 susvisée, à savoir que ces contributions peuvent être modulées en fonction « des pratiques industrielles et commerciales des producteurs ».Par ailleurs, lors des échanges avec la Commission européenne, dans le cadre de la notification au titre de la directive 2015/1535, cette dernière a demandé que les critères et modalités d’établissement de la modulation soient établis au sein d’un texte faisant l’objet d’une concertation avec les acteurs concernés, ce qui est le cas du cahier des charges de la filière REP.Ainsi il est proposé de reprendre dans le texte de loi :- d’une part les termes employés dans la directive 2025/1892 susvisée, à savoir que les modulations relatives aux pratiques industrielles et commerciales peuvent porter sur des critères tels que « l’étendue de la gamme de produits ou la fréquence des offres », en sus de l’incitation à réparer (qui figure déjà dans le texte de loi à l’instar de la directive » ;- d’autre part de renvoyer explicitement au cahier des charges les conditions d’application de la modulation (dans le cas d’espèce : la définition plus précise des critères, la formule et le score en dessous duquel est déclenché la pénalité)En outre, comme rappelé dans les considérants de la directive 2025/1892, les modulations ont vocation à constituer un instrument efficace pour favoriser une conception plus durable des produits et la pénalité relative à la mode ultra éphémère vise notamment à limiter la surconsommation de produits textiles. Par ailleurs, comme cela a été rappelé par la Commission, ces modulations doivent être proportionnées aux enjeux et donc aux produits concernés et aux déterminants conduisant à cette surconsommation en présentant un caractère d’incitativité suffisant pour atteindre leur objectif.C’est pour cela qu’il est proposé d’augmenter la limite haute de la pénalité, dont les montants par catégorie de produits seront ensuite fixés parmi cette « fourchette » de valeurs dans l’arrêté portant cahier des charges. Le doublement proposé du plafond de la pénalité permettra, au niveau de l’arrêté, d’assurer une différenciation plus fine entre les différentes catégories de produits. Ainsi il sera possible de prévoir pour des produits comme les manteaux, les vestes ou les pantalons, dont le prix de vente est significativement supérieur à des chaussettes ou des caleçons, un montant de pénalité bien supérieur aux montants de 6 € en 2026 (10 € en 2030) actuellement prévus dans le projet de loi, qui ne constituent pas des montants suffisamment incitatifs pour ce type de produits. Ces montants sont proportionnés au regard des externalités négatives générées sur l’ensemble du système de gestion des déchets de l’ultra fast fashion. En effet, ces produits contribuent fortement à l’accroissement du gisement de déchets textiles, dégradent la qualité et la valeur du gisement collecté.Ces plafonds révisés permettront également de générer plus de contributions de la part des entreprises les moins vertueuses qui pourront être utilisées par les éco-organismes pour financer notamment des infrastructures de collecte, de tri, de réemploi et de préparation en vue de la réutilisation et de recyclage sur le territoire national. A ce titre, il est proposé dans cet amendement de reprendre de façon plus complète les termes de la directive 2025/1892, et donc d’ajouter le tri, qui constitue un maillon indispensable à la gestion des textiles usagés, ainsi que la préparation en vue de la réutilisation.Enfin, afin de permettre un contrôle des données par les éco-organismes pour identifier les acteurs soumis à la pénalité et les montants afférents, la loi permet aux éco-organismes de mettre en œuvre des collectes automatisées de données ou d’information sur les interfaces en ligne permettant la vente à distance ou la livraison des produits. Cette disposition est indispensable pour permettre une bonne mise en œuvre du dispositif de malus. Toutefois certaines mentions figurant dans le texte devraient nécessiter une notification auprès de la Commission Européenne au titre de la directive 2015/1535 susmentionnée. Il est donc proposé, pour ne pas fragiliser la loi, de retirer ces dispositions de la loi et de les renvoyer à un décret, qui pourra faire l’objet d’une notification ultérieure.
