Ce que proposait le sous-amendement

Par ce sous-amendement de repli, les député.es du groupe LFI souhaitent garantir un seuil à 1000 participants attendus pour l’obligation de déclaration.Le seuil actuel est de 500 participants et est déterminé par voie réglementaire. Nous proposons de l’augmenter à 1000 participants.L’objectif de… Par ce sous-amendement de repli, les député.es du groupe LFI souhaitent garantir un seuil à 1000 participants attendus pour l’obligation de déclaration.Le seuil actuel est de 500 participants et est déterminé par voie réglementaire. Nous proposons de l’augmenter à 1000 participants.L’objectif de cette réduction est d’étendre le champ d’application de la peine de prison et d’amende créés par la présente proposition de loi.Depuis 2002, et la loi sur la sécurité quotidienne, les rassemblements musicaux sont soumis à un régime juridique dérogatoire de déclaration lorsque le nombre de participants attendu dépasse les 500 personnes (art. R 211‑2 CSI) contre 1 500 pour les autres rassemblements. L’existence d’un seuil doit garantir un équilibre entre, d’une part, la liberté de réunion ainsi que la liberté d’expression et, d’autre part, la nécessité de préserver l’ordre public. Or, le seuil de 250 personnes tel que prévu par le projet de loi est manifestement disproportionné et ne permet pas de garantir ces libertés.Nous défendons au contraire un accompagnement de ces rassemblements musicaux, tant par la médiation au niveau local avec les collectivités accueillantes que par les forces de l’ordre. Nous estimons que seule cette approche permet de limiter les risques et les troubles inhérents à tous les types de rassemblements musicaux.
