Ce que proposait l'amendement

Le présent amendement a pour objet d’intégrer, dans le code des transports, des dispositions relatives à la navigation sous l'empire de substances ou plantes classées comme stupéfiants pour les gens de mer à bord des navires et de créer un nouveau cadre relatif à l’alcoolémie et aux substances ou… Le présent amendement a pour objet d’intégrer, dans le code des transports, des dispositions relatives à la navigation sous l'empire de substances ou plantes classées comme stupéfiants pour les gens de mer à bord des navires et de créer un nouveau cadre relatif à l’alcoolémie et aux substances ou plantes classées comme stupéfiants pour les plaisanciers conducteurs de navires de plaisance à moteur nécessitant d’être titulaire du permis de conduire pour les bateaux à moteur (PCBM), pour lesquels il n’existe aujourd’hui aucun cadre légal ni pour l’alcoolémie ni pour l’usage de stupéfiants.S’agissant des gens de mer :La section 5 (réglementation de l’alcoolémie à bord des navires) du chapitre 1er (police intérieure et discipline à bord) du titre III (la collectivité du bord) du Livre V (les gens de mer) de la cinquième partie (transport et navigation maritimes) du code des transports est modifiée afin de mettre en cohérence les peines encourues avec les évolutions intervenues dans le code de la route lorsque des gens de mer sont sous l’empire d’un état alcoolique. Ces peines passent de 2 ans d’emprisonnement et 4 500€ d’amende à 3 ans d’emprisonnement et 9 000 € d’amende.Par ailleurs, le livre V (les gens de mer) ne prévoyant aucune disposition pour l’usage de stupéfiants pour les gens de mer, il est créé une section 6 (Dispositions pénales en cas d’usage de substances ou plantes classées comme stupéfiants à bord des navires) qui s’applique à l’ensemble des gens de mer dans l’exercice de leur fonction à bord, en cohérence avec le champ d'application des dispositions déjà introduites pour l’alcoolémie. Cette section interdit aux gens de mer dans l’exercice de leur fonction de se trouver sous l’empire de stupéfiants et crée des sanctions pénales. C’est l’objet du nouvel article L5531-50.S’agissant des plaisanciers :Au chapitre II (sécurité de la navigation) du titre IV (sécurité et prévention de la pollution) du livre II (navigation maritime) de la même cinquième partie de ce code, il n’existe actuellement aucune disposition applicable à la navigation sous l’empire de l’alcool, de stupéfiants ou de substances psychoactives pour les plaisanciers.Cet amendement crée, pour les plaisanciers conducteurs de bateaux à moteur soumis à permis :-un article L. 5242-25, dans une nouvelle section 6, pour la navigation sous l’empire d’un état alcoolique,-un article L. 5242-26, dans une nouvelle section 7, pour la navigation sous l'empire de substances ou plantes classées comme stupéfiants.Enfin, le présent amendement prévoit une habilitation à prendre une ordonnance afin de compléter les régimes d’interdictions et de sanctions en matière d’alcoolémie et de stupéfiants, de créer un régime d’interdictions et de sanctions en matière de substances psychoactives, et à décliner l’ensemble des conditions de mise en œuvre de ces dispositifs ainsi introduits dans le code des transports.
