L’article 10 crée un cadre procédural renforcé afin que les actes essentiels d’enquête soient accomplis rapidement lorsqu’un crime ou un délit mentionné à l’article 706-47 du code de procédure pénale est commis sur un mineur.En commission, le dispositif a été utilement étendu aux procédures… L’article 10 crée un cadre procédural renforcé afin que les actes essentiels d’enquête soient accomplis rapidement lorsqu’un crime ou un délit mentionné à l’article 706-47 du code de procédure pénale est commis sur un mineur.En commission, le dispositif a été utilement étendu aux procédures ouvertes non seulement à la suite d’une plainte, mais également à la suite de la réception par le procureur de la République d’un signalement ou d’une dénonciation. Cette évolution est indispensable : dans de nombreuses situations, l’enfant victime n’est pas en capacité de déposer plainte, sa famille peut être défaillante ou les faits peuvent s’inscrire dans un cadre intrafamilial.Il convient toutefois d’assurer la pleine coordination de cette extension.D’une part, l’article prévoit qu’à l’expiration d’un délai de trois mois, le procureur de la République informe le plaignant des éléments de l’enquête qu’il estime utiles ainsi que de son droit d’être aidé par une association d’aide aux victimes. Or, lorsque la procédure résulte d’un signalement ou d’une dénonciation, il peut ne pas exister de plaignant.Le présent amendement prévoit donc que cette information puisse être délivrée, selon les cas, au mineur désigné comme victime, dans des conditions adaptées à son âge et à sa compréhension, à ses représentants légaux lorsqu’ils ne sont pas mis en cause, ou à l’administrateur ad hoc lorsqu’il en a été désigné un.D’autre part, il coordonne la clause d’entrée en vigueur de l’article 10 afin qu’elle vise également les signalements et dénonciations reçus par le procureur de la République.
