Par cet amendement, élaboré en concertation avec l'UNICEF, la CNAPE et le Gepso, il est proposé de supprimer l'obligation de recueillir l'avis de la commission d'examen de la situation et du statut des enfants confiés lors du renouvellement des mesures de placement de longue durée.Si la nécessité… Par cet amendement, élaboré en concertation avec l'UNICEF, la CNAPE et le Gepso, il est proposé de supprimer l'obligation de recueillir l'avis de la commission d'examen de la situation et du statut des enfants confiés lors du renouvellement des mesures de placement de longue durée.Si la nécessité d’un examen régulier de la situation des enfants confiés à l’aide sociale à l’enfance doit être prise en compte,le dispositif adopté en commission soulève d'importantes difficultés pratiques. En effet la commission d'examen de la situation et du statut des enfants confiés n'est aujourd'hui ni installée ni pleinement opérationnelle dans l'ensemble des départements. Suboordonner la condition de son avis préalable pour renouveler une mesure une placement risquerait de retarder, voir de fragiliser la continuité de la prise en charge des enfants, en faisant dépendre le renouvellement d'une mesure de protection du fonctionnement d'une instance dont le déploiement demeure inégal sur le territoire.Cette commission n’a pas vocation à examiner systématiquement l’ensemble des mesures de placement ni à constituer une étape obligatoire préalable au renouvellement d’une mesure judiciaire décidée par le juge des enfants. Son intervention répond aujourd’hui à un cadre précis : elle examine la situation des enfants confiés à l’aide sociale à l’enfance depuis plus d’un an lorsqu’il existe un risque de délaissement parental ou lorsque leur statut juridique apparaît inadapté à leurs besoins.En faisant de cette commission un acteur général du réexamen des placements de longue durée, la disposition proposée modifierait substantiellement sa finalité et ses missions, alors même qu’elle ne dispose pas des moyens nécessaires pour assurer un tel rôle. Elle créerait également une confusion entre l’intervention d’une instance administrative départementale, dont l’avis est transmis au président du conseil départemental, et l’intervention de l’autorité judiciaire, seule compétente pour décider du renouvellement d’une mesure d’assistance éducative.Enfin, le statut juridique de l’enfant ne saurait être confondu avec l’évaluation globale de sa situation. Le droit distingue l’appréciation des besoins de l’enfant, l’élaboration et l’actualisation de son projet pour l’enfant ainsi que, lorsque cela apparaît nécessaire, l’examen de l’adéquation de son statut juridique à ses besoins. Faire de ce dernier examen une condition du renouvellement des mesures de placement risquerait d’introduire une confusion entre ces différentes étapes et de complexifier davantage les parcours des enfants confiés.
