Le présent sous-amendement complète le régime des incapacités du code de la santé publique (XV de l'amendement) par deux mesures issues de l'amendement n° 1173, sans modifier l'économie de la réécriture.L'affaire Le Scouarnec a montré que les enfants figurent parmi les patients les plus exposés aux violences commises dans le cadre des soins, et que la protection demeure lacunaire tant qu'aucune condamnation définitive n'est intervenue.Le nouvel article L. 1191‑6 institue une mesure conservatoire de suspension, prononcée sans délai par le directeur général de l'agence régionale de santé. Elle complète les articles L. 1191‑2 et L. 1191‑3 sur trois points : elle se déclenche dès la saisine de la juridiction disciplinaire, soit en amont de toute inscription à un fichier ; elle revêt un caractère quasi automatique, là où l'interdiction prévue au II de l'article L. 1191‑2 relève de l'appréciation de l'autorité ; et elle est maintenue jusqu'à la décision définitive, ne pouvant être levée que par une décision spécialement motivée établissant l'absence de risque. Mesure de protection et non sanction, elle repose sur des déclencheurs objectifs et garantit le respect de la présomption d'innocence et le caractère proportionné de la mesure.Le nouvel article L. 1191‑7 organise la transmission sans délai, au directeur général de l'agence régionale de santé, des informations détenues par les autorités judiciaires, administratives et ordinales, puis leur relais aux employeurs. Il comble une lacune du dispositif : le canal ordinal – agence régionale de santé, propre au secteur sanitaire, n'est pas couvert par le mécanisme général d'information prévu à l'article 11‑4 du code de procédure pénale.Compte tenu de la gravité des situations visées, le II du présent sous-amendement prévoit, par dérogation à l'entrée en vigueur différée du XV (XIX, C), une application dans les trois mois suivant la publication de la loi.Ce sous-amendement a été travaillé avec Stop VOG.
