Le présent amendement vise à garantir que l’interopérabilité des systèmes d’information en protection de l’enfance ne se limite pas à un objectif technique, mais contribue concrètement à la protection effective des enfants.L’article 7 crée des référentiels d’interopérabilité, de sécurité et… Le présent amendement vise à garantir que l’interopérabilité des systèmes d’information en protection de l’enfance ne se limite pas à un objectif technique, mais contribue concrètement à la protection effective des enfants.L’article 7 crée des référentiels d’interopérabilité, de sécurité et d’éthique applicables aux systèmes d’information, services et outils numériques utilisés pour la mise en œuvre de la politique de protection de l’enfance. Ces référentiels doivent permettre un meilleur partage de l’information entre les acteurs compétents. Encore faut-il que ce partage soit traçable, daté, suivi et exploitable lorsque la situation d’un mineur appelle une réaction rapide.Plusieurs affaires récentes ont montré que la défaillance ne tient pas seulement à l’absence d’information, mais aussi à l’absence de suivi effectif de cette information : transmission non tracée, absence d’accusé de réception, absence d’alerte sur les délais, impossibilité d’identifier clairement si une procédure sensible a été prise en compte et suivie.Le pré-rapport d’inspection relatif à l’affaire Lyhanna illustre cette faille. Il relève notamment que l’outil Cassiopée n’est pas conçu comme une application de suivi des délais et des procédures sensibles, et recommande de rénover les outils numériques d’enregistrement, de signalement et de suivi de l’activité judiciaire.Sans viser un outil particulier, cet amendement tire les conséquences de ces constats en précisant que les référentiels prévus par l’article 7 doivent pouvoir inclure des exigences relatives à la traçabilité des accès et des transmissions, à l’horodatage, à l’accusé de réception et au suivi des délais de traitement des informations relatives à un mineur en danger ou en risque de danger, en particulier lorsqu’une situation de danger grave apparaît.Il ne s’agit pas de créer un nouveau fichier ni une nouvelle procédure, mais de garantir que les outils numériques utilisés par les acteurs de la protection de l’enfance permettent effectivement de suivre les informations sensibles et d’éviter qu’un enfant soit exposé à un danger faute d’alerte, de traçabilité ou de pilotage des délais.Cette précision s’inscrit pleinement dans l’objectif de l’article 7 : améliorer la coordination entre les acteurs de la protection de l’enfance et assurer un suivi plus fiable des enfants protégés.
