Cet amendement des députés socialistes et apparentés vise à ramener la peine pour viol sériel commis sur mineur de moins de 15 ans de la perpétuité à 30 ans d'emprisonnement.Le droit pénal prévoit une gradation des peines en matière de viol afin de tenir compte de la gravité des faits et d'assurer… Cet amendement des députés socialistes et apparentés vise à ramener la peine pour viol sériel commis sur mineur de moins de 15 ans de la perpétuité à 30 ans d'emprisonnement.Le droit pénal prévoit une gradation des peines en matière de viol afin de tenir compte de la gravité des faits et d'assurer une répression proportionnée.Le viol dans sa forme simple est puni de quinze ans de réclusion criminelle (article 222-23 du code pénal).Le viol aggravé par au moins l'une des circonstances prévues à l'article 222-24 du code pénal ou aux articles 222-23-1 et 222-23-2 est puni de vingt ans de réclusion criminelle.Lorsque le viol a entraîné la mort de la victime, il est puni de trente ans de réclusion criminelle.Enfin, le viol est puni de la réclusion criminelle à perpétuité lorsqu'il est précédé, accompagné ou suivi d'actes de torture ou de barbarie (articles 222-25 et 222-26 du code pénal).Le présent amendement propose de substituer à la réclusion criminelle à perpétuité une peine de trente ans de réclusion criminelle lorsque le viol est commis sur un mineur de quinze ans et en concours avec un ou plusieurs autres viols commis sur d'autres victimes.Cette rédaction s'inscrit dans le prolongement de l'avis du Conseil d'État qui relève que « le viol ayant entraîné la mort est puni de trente ans de réclusion criminelle, que le viol en concours est puni, en l'absence de victime mineure de quinze ans, de vingt ans de réclusion criminelle et que le cumul de plusieurs circonstances aggravantes du viol n'est pas sanctionné davantage que chaque circonstance aggravante prise isolément ».Le Conseil d'État invite ainsi le Gouvernement « à rechercher une plus grande cohérence dans l'échelle des peines en matière de viol ».L'échelle des peines repose en effet sur deux principes essentiels : la proportionnalité entre la gravité de l'infraction et la peine encourue, et la cohérence entre les différentes incriminations.La réclusion criminelle à perpétuité constitue la peine la plus élevée de notre droit pénal et demeure réservée aux crimes d'une exceptionnelle gravité. Instituer une telle peine pour cette nouvelle incrimination spécifique créerait une rupture importante dans la gradation des sanctions, alors même que le viol ayant entraîné la mort demeure puni de trente ans de réclusion criminelle.En outre, une telle évolution pourrait exposer la disposition à un risque de censure par le Conseil constitutionnel au regard des principes de nécessité et de proportionnalité des peines.Une éventuelle déclaration d'inconstitutionnalité aurait pour conséquence de priver le dispositif de tout effet utile, alors même que l'objectif poursuivi est de renforcer la répression de ces crimes particulièrement graves.Le choix d'une peine de trente ans de réclusion criminelle permet, à l'inverse, d'accroître très significativement la sévérité de la réponse pénale tout en préservant la cohérence de l'échelle des peines.Il instaure un palier intermédiaire cohérent entre les vingt ans de réclusion criminelle applicables au viol aggravé et la réclusion criminelle à perpétuité réservée aux hypothèses les plus exceptionnelles.Le présent amendement concilie ainsi l'objectif de fermeté poursuivi par le texte avec les exigences constitutionnelles de nécessité, de proportionnalité et de cohérence des peines, tout en répondant aux observations formulées par le Conseil d'État.
