Ce que proposait l'amendement

L'article 63 ouvre l'accès au marché du travail au demandeur d'asile qui a déposé plainte pour des faits de violences sexuelles ou qui, « sans avoir déposé plainte, produit des éléments sérieux et concordants permettant de présumer la réalité de tels faits », par dérogation à la règle de l'article… L'article 63 ouvre l'accès au marché du travail au demandeur d'asile qui a déposé plainte pour des faits de violences sexuelles ou qui, « sans avoir déposé plainte, produit des éléments sérieux et concordants permettant de présumer la réalité de tels faits », par dérogation à la règle de l'article L. 554-1 du code de l'entrée et du séjour des étrangers et du droit d'asile, qui réserve cet accès au demandeur dont la demande n'a pas été instruite dans un délai de six mois pour des raisons qui ne lui sont pas imputables.Le Conseil d'État, dans son avis du 16 juillet 2026 (points 217 à 220), a relevé que cette dérogation « introduit des considérations d'une nature différente » de celles qui gouvernent l'accès à l'emploi des demandeurs d'asile, et qu'elle supposait de remettre en cause la procédure d'autorisation de travail elle-même, l'employeur ne pouvant recevoir d'informations sur les faits allégués ; il a indiqué ne pas être en mesure de se prononcer sur une telle réforme dans le cadre de ce texte. La commission n'a pas tiré la conséquence de cette réserve : elle a créé une procédure de demande parallèle, présentée par le demandeur lui-même, et elle a étendu le bénéfice de l'article aux personnes qui n'ont pas porté plainte.Le résultat est une dérogation fondée sur une allégation. Le demandeur d'asile qui déclare avoir subi des violences sexuelles, en produisant des éléments que rien n'impose de vérifier, obtient immédiatement ce que la loi refuse aux autres demandeurs pendant six mois. L'autorité administrative devra apprécier, dans une procédure d'autorisation de travail, la vraisemblance d'infractions sexuelles qu'aucun juge n'a examinées. Et l'accès au travail, qui est l'un des premiers facteurs d'attractivité d'une demande d'asile, se trouve conditionné à une déclaration que les réseaux de passeurs fourniront aux intéressés.La protection des demandeurs d'asile victimes de violences relève des dispositifs d'accompagnement et d'hébergement, non d'un régime dérogatoire d'accès à l'emploi bâti sur une présomption sans contrôle. Le présent amendement supprime donc l'article.
